Am I a contractor?

Contractors who perform contract cleaning work can register for the scheme. You must also register if you employ people to perform cleaning work.

The scheme does not cover you if you are:

  • engaged solely to supervise workers
  • performing only or mainly managerial or clerical duties
  • under contract or service with a Commonwealth, State, Territory or Local Government authority
  • directly employed by the owner of the premises you clean.

As Commonwealth places fall under the jurisdiction of the Commonwealth Government, work conducted on Commonwealth places cannot be credited under the NSW Contract Cleaning Industry Long Service Leave (CCI LSL) scheme, administered by the Long Service Corporation (LSC).

We are working with the Commonwealth Government to resolve this.

Several factors determine if you are a contractor or an employee. You should take into account all of your working arrangements. This includes your ability to delegate, how you're paid and who provides the equipment you use.
