Protections for registered workers on Commonwealth places
In November 2024, the NSW Government passed the Portable Long Service Leave Legislation Amendment Act 2024 to prevent the cancellation of worker registration due to work on Commonwealth places leading to a break in service credits.
This applies to both the Building and Construction Industry Long Service Payments (BCI LSP) and NSW Contract Cleaning Industry Long Service Leave (CCI LSL) schemes.
The amendments mean that registered workers on Commonwealth places are no longer at risk of having their registration cancelled. They do not mean that service credits can be recorded for work on Commonwealth places – work on a Commonwealth place will continue to be ineligible.
If a worker has already had their registration cancelled due to working on a Commonwealth place, the Long Service Corporation can now reinstate the registration and restore any service credits the worker had accrued prior to cancellation for work outside of a Commonwealth place.
The Long Service Corporation has identified affected workers and will write to them personally. More information on how these protections will operate will be published shortly.
