Who we are
The Long Service Corporation (LSC), part of the NSW Department of Customer Service (DCS), administers the Community Services Sector (Portable Long Service Leave) Act 2024 and manages personal information in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).
Why we are collecting worker information from you
LSC collects worker information indirectly from registered employers so we can perform our statutory functions, including:
- keeping a Register of Workers
- recording each employer for whom an employee works
- receiving required service returns and worker service information
- administering the community services portable long service leave scheme (the Scheme).
The kinds of information we collect
Through the Employer Portal (CSV upload and/or manual entry), we may collect worker information such as:
- Personal details – name, date of birth, telephone number, email address and address
- Registration information – the worker’s registration number (if the worker is registered)
- Employment and role details – the nature of the community service work performed, the worker’s start and cessation dates, and any long service leave granted
- Contractor information – a worker’s ABN, where the worker is engaged as a contractor
- Service return information – ordinary remuneration for each return period, number of days worked each return period, wages and status details used to calculate service days and levy amounts
- Pro‑rata payment information – details of any pro‑rata payments made under section 52.
Failure to provide information
Under the Act, employers must register and provide returns and information required for scheme administration. Failure to provide accurate information may result in incomplete worker records, incorrect levy calculations, service not being credited, or non compliance with the Act (See Part 2 and Part 4 obligations on employer registration and returns).
How we may use this information
We may use the information we collect to:
- register workers and maintain the Register of Workers (including employer linkages and service history)
calculate service days and generate levy notices for each service return period - verify service, reconcile data and conduct audits and compliance activities
- communicate with you (and, where appropriate, the worker) about record accuracy, returns and obligations
- respond to and communicate about complaints, enquiries and requests in relation to the Scheme
- support service planning, policy development, evaluation and research relating to LSC’s statutory functions
- prepare and provide relevant information to the Community Services Industry Portable Long Service Leave Committee if a decision made by the LSC is appealed
- process future long service leave claims
- carry out any other purpose directly related to administering the Scheme.
Who we may share information with
We may share worker information:
- with Service NSW, as a service delivery partner, where necessary to administer and deliver the Scheme
- with other NSW, interstate or territory government agencies, or scheme administrators, where necessary to verify information or recognise eligible service performed in another state or territory
- with the Community Services Industry Portable Long Service Leave Committee, where required of an appeal
- with the worker to whom the information relates, including for access and correction, entitlement assessment, and resolving enquiries or disputes.
We will not disclose worker information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. For more information, see our Privacy Statement.
Protecting information
We take steps to protect your information from loss, unauthorised access, misuse, modification, or disclosure.
Your personal information is stored in secure systems hosted in Australia. These environments are implemented under security controls that have been reviewed and approved by Cyber Security NSW.
Your information is managed in line with the PPIP Act and kept only for as long as necessary for the purposes for which it was collected. When no longer required, it is disposed of securely in accordance with the State Records Act 1998.
Access and correction
Workers (and where appropriate, employers) can request access to, and correction of, personal information held by LSC under the PIPP Act.
