How we handle your personal information when you apply for special service credits with the Long Service Corporation.

Who we are

Your information is being collected by the Long Service Corporation, an agency within the NSW Department of Customer Service. The NSW Department of Customer Service gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

Why we collect your personal information

We collect personal information for the purposes of determining your application for special service credits in accordance with Part 3, Division 3, Sections 21 to 25 of the Building and Construction Industry Long Service Payments Act 1986.

The kinds of information we collect

We may collect the following information:

  • details of your employment which is not shown in your service history record, including who you were employed by,your employer’s contact details, and the type of work you performed
  • supporting documents to demonstrate your employment such as payslips, tax returns, and apprenticeship papers (if applicable)
  • details of the reasons you have been unable to work in the building industry, including details of any illness/injury* which has prevented you from working, or any periods of unpaid work or training
  • supporting documents to demonstrate why you were unable to work, including a medical certificate or letter from your workers compensation insurer (if applicable)*
  • additional personal information if it is required to demonstrate the eligibility requirements for special service credits

*This information is ‘health information’ and attracts a higher level of protection under the Health Records and Information Privacy Act 2002.

Failure to provide information

Your information is provided voluntarily however if you choose not to provide your information, your application for service credits may not be able to be determined.

How we may use this information

We may use the information we collect in the following ways:

  • To determine your application for special service credits in accordance with Part 3, Division 3, Sections 21 to 25 of the Building and Construction Industry Long Service Payments Act 1986.
  • To enable us to administer the building and construction industry portable long service payment scheme, including contacting you in relation to your application.
  • To support more informed policy making, program management, evaluation, research and service planning as it can facilitate more efficient service delivery for the building and construction industry in NSW.
  • Other directly related purposes.

Who we may share your information with

We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. Our privacy statement provides further information about how we may share personal information.

If required, we may make enquiries and exchange information with other NSW Government agencies, or other states, territories and/or the Commonwealth for the purposes of recognising eligible work and long service payments recorded in another state or territory, verifying the information you provide or requesting additional information. We may disclose your information with such bodies for these purposes.

Service NSW

Service NSW provides a digital front door for this application, and your MyServiceNSW Account may be used to initiate this application and verify your identity. ServiceNSW collects and uses your personal information to:

  • Initiate the application using your MyServiceNSW Account details.
  • Verify your identity with the Document Verification Service.
  • With your consent, share details from your MyServiceNSW Account with the Long Service Corporation.

Other information that you provide through the application to demonstrate your eligibility for registration will not be collected or stored by Service NSW.

Service NSW maintains and uses your personal information for internal administrative purposes, including for the purposes of our interactions with you.

Protecting your information

We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.

We will store and manage your information in accordance with the provisions of the PPIP Act and HRIP Act.

We will only keep information for as long as we need it to fulfil the purposes we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
