Registration cancellation
Under the legislation, the Corporation is required to cancel your worker registration if you:
- are not eligible to be registered
- do not record any service for at least 4 years in a row
- have been paid a pro rata payment after permanently leaving the industry, or
- have asked us to cancel your registration.
We will notify you if a decision is made to cancel your registration.
Reinstatement of a cancelled registration
If your registration is cancelled because you did not record service credits for 4 years in a row, you can apply to have it reinstated within 6 years of the date of cancellation.
You need to provide special circumstances before the Corporation can consider the reinstatement of your registration.
If your registration is reinstated, all your previously recorded service will count towards any future long service leave payment.
Registration suspension
We can suspend your registration if you have more than 5 years of service credits, but have not been credited with any service for the last 4 years.
If your registration is suspended, you will not be able to record any further service credits, and you will not receive an annual statement.
If your registration is suspended, you can apply for a pro rata payment if you have:
- permanently left the industry; and
- 10 weeks have passed since you permanently left the industry; and
- no service credits have been recorded in that 10-week period.
Restoration of a suspended registration
A suspended worker can apply at any time for restoration of your registration and previous service credits. Once your registration is restored, you can start recording service again.
Appeal a decision
You can appeal to the Community Services Sector Long Service Leave Committee if we notify you that your registration is about to be cancelled because:
- you were not eligible to register, or
- you did not record any service for at least 4 years in a row.
Committee members include employer and union representatives from the community services sector in NSW.
How to appeal
Return the appeal form sent to you with your decision letter, you must submit your appeal within 42 days from the date of the decision letter.
The committee reviews information used in the original decision along with other information provided.
Your appeal:
- must explain why the original decision should be overturned – for example, where the decision was based on incorrect or misinterpreted information
- should include supporting documents – for example, work diaries, a letter from an employer detailing work performed and period of employment, position description, references, statutory declarations or invoices showing the work performed
The Committee Chairperson may accept an appeal within 6 months in the event of exceptional circumstances.
We send you the outcome of your appeal in writing.
