Employers eligible under the scheme
Eligible employers are people who employ 1 or more persons to do community service work in NSW or supply a person through a labour hire arrangement to do community service work in NSW.
Community service work is defined as:
- work to provide a community service, or
- work for an employer, if the predominant purpose of the employer is to provide a community service.

Commonwealth, State or Local Government authorities are not considered employers.
An employer is not a company whose only workers are directors, if each of the directors participates in the management of the company or shares its profits.
Workers eligible under the scheme
Workers are paid staff employed on a full-time, part-time and casual basis to do community service work in NSW.
Self-employed contractors doing community service work in NSW can opt-in to the scheme by registering themselves as workers. Their participation is not mandatory.
Workers not eligible under the scheme
The scheme does not cover someone doing community service work under:
- a contract of service with a partnership if the person is a partner and participates in the management of the partnership or shares the profits, or
- a contract, whether or not a contract of service, with a corporation of which the person is a director, or
- a contract, whether or not a contract of service, with a trust of which the person is a trustee, or
- a worker who is directly employed by a Federal, State or Local Government agency. (Workers of organisations who receive funding from Government agencies to provide a community service, are included in the scheme).
