Who is a worker?

The scheme covers employees and contractors in the contract cleaning industry. An employee is someone employed under a contract of service by an employer to perform cleaning work. A worker can be full-time, part-time or casual.

Check with the ATO or Fair Work if you’re unsure whether you are an employee or a contractor.

Who is not covered by the scheme?

The scheme does not cover someone who is:

  • engaged solely to supervise workers
  • performing only or mainly managerial or administration duties
  • a partner in a partnership they work for
  • a director of the company they work for
  • a trustee of the trust they work for
  • directly employed by the owner of the premises they clean
  • under a contract of service with a Commonwealth, state, territory or local government authority.

As Commonwealth places fall under the jurisdiction of the Commonwealth Government, work conducted on Commonwealth places cannot be credited under the NSW Contract Cleaning Industry Long Service Leave (CCI LSL) scheme, administered by the Long Service Corporation (LSC).

We are working with the Commonwealth Government to resolve this.

Whilst work on Commonwealth places does not currently count towards portable long service, the Corporation is maintaining records of this work to benefit you when we are able to count it. In this regard, all workers should register in the LSC portable long service scheme so we can have your service recorded.
